GetMyOpinion is an independent specialist in the collection, moderation, and publication of customer reviews online for B2C and B2B. The GetMyOpinion online review solution aims to evaluate the service provided by a service provider and enhance the experience of its customers online.
GetMyOpinion is a trusted third party that certifies the authenticity of reviews and ensures total transparency in the calculation of ratings. It guarantees complete transparency towards Providers and Consumers. It undertakes to transmit and publish information, ratings, and comments strictly identical to those it collects, except for any illegal or illicit mentions and statements.
It is expressly reminded that the content of comments must not contravene current laws and regulations.
Our solution complies with decree n°2017-1436 of September 29, 2017, regarding information obligations related to online consumer reviews.
The purpose of these General Terms of Use (GTU) is to define the conditions relating to the operation of the services offered by GetMyOpinion applicable to Consumers who submit their Review.
Non-compliance with these GTU may lead to the rejection or removal of a Review.
Any person is informed that by submitting a Review on a Product or Service, they acknowledge having read these GTU and accept them without reservation in their entirety.
The GetMyOpinion customer review solution is based on post-transaction Review collection. Review requests are therefore linked to a consumption experience (purchase of a Product or Service) and a clearly identified Consumer.
Consumers are solicited by email or SMS with an active link inviting them to share their Review on the Product or Service provided by the Provider. The email specifies the identity of the Provider and the Product or Service for which the Review is solicited. The solicitation of the Review does not include any commercial offer, invitation, or additional advertising.
Consumer identification is done via the email address or mobile phone number communicated to GetMyOpinion by the Providers. The Consumer may be re-contacted by GetMyOpinion for verification purposes. To this end, the Consumer guarantees the accuracy and authenticity of the personal data communicated to GetMyOpinion.
The submission of a Review by the Consumer is voluntary and optional.
Consumers who submit a Review must imperatively respect the following conditions:
• be a natural person;
• not be in a situation of conflict of interest with the Provider (a situation in which the Consumer has interests related to the Provider, the Product, or the Service, which could compromise the independence of their Review);
• have personally had the consumption experience of the Product or Service on which their Review is based;
• have confirmed their phone number or email address to GetMyOpinion upon request.
Through the email or SMS of the Review request, the Consumer accesses a satisfaction questionnaire to submit their Review. Only fully completed questionnaires will be considered. The Review must notably include an overall rating concerning the appreciation of the Product or Service.
The Consumer acknowledges and accepts that published Reviews are not confidential and private. The Consumer accepts that the Provider and GetMyOpinion may publish the Reviews on their respective websites as indicated in Article 6. The Consumer's first name, the initial of their last name, and, where applicable, the model of their vehicle will therefore be published with the Review.
The Consumer guarantees the sincerity and authenticity of their Review and that, to their knowledge, all information provided is factually correct.
They are prohibited from making inappropriate, defamatory statements, or statements contrary to law and morality. The content of the Review may notably be rejected in the cases provided for in Article 5.
The responses to the questionnaire are intended, on the one hand, for statistical processing, and on the other hand, to constitute the Review that will be published as indicated in Article 6.
GetMyOpinion may refuse the submission of Reviews by a Consumer if the Consumer has, in the past, submitted one or more Reviews detected as fraudulent by GetMyOpinion.
All responses to the satisfaction questionnaire and elements specified in the Review are subject to moderation.
The objective of this moderation is to ensure that Reviews comply with French legislation and these GTU in order to publish, reject, or delete these Reviews.
All interveners and actions related to moderation are identified and traceable.
Each positive or negative Review is subject to human moderation a priori within a maximum period of 7 working days from the submission of the Review by the Consumer. GetMyOpinion also uses a posteriori and human moderation.
GetMyOpinion reserves the right not to publish a Review in the following cases:
Moderation is carried out by human beings generally referred to as moderators. GetMyOpinion undertakes that its staff in charge of moderation meet the required conditions, namely:
• Master perfectly the language in which the Review was written. This mastery must have been objectively validated before taking up the position, equivalent to a "Mastery" level of the Common European Framework of Reference for Languages (C2 level of the CEFR);
• Access the entire content of the Review collected from the Consumer and the history of the Review submission (for example, number of submissions of the same Review);
• Access elements relating to the identity of the Consumer author of the Review collected during the Review submission to be able to contact them if necessary, as well as the history concerning this Consumer (number of published Reviews, subject of previous Reviews);
• Access all historical Reviews submitted on a Product or Service, whether they have been accepted or rejected;
• Be able to entrust, in a traceable manner, the moderation of a Review to another moderator.
GetMyOpinion ensures that persons authorized to process personal data in the context of moderation undertake to respect their confidentiality.
GetMyOpinion undertakes to inform the Consumer of the rejection of their Review and to give them the reasons for the rejection.
GetMyOpinion undertakes to keep a history of all rejected Reviews in its databases.
After validation, Reviews will be published as follows.
The Consumer accepts that their Reviews may be displayed:
• On websites operated by GetMyOpinion in the context of its activity, notably the sites accessible at www.app.getmyopinion.eu as well as on its social media pages and digital or paper commercial supports in the context of its prospecting and information activity for its prospects and customers;
• On the Provider's website(s) and its social media pages, solely to inform future consumers about the level of service and quality of the Provider.
GetMyOpinion undertakes not to modify any Review.
Each Review, whether positive or negative, is displayed provided it has not been rejected during the moderation process provided for in Article 5. Reviews may not be published more than one month after their submission, except for the exception mentioned below.
Reviews are displayed in reverse chronological order from most recent to oldest based on the Review submission date.
The information published with the Reviews are:
• Consumer profile data indicated as intended to be published;
• The Review publication date;
• The Review submission date;
• The type and date of the consumption experience;
• The name of the company to which the Consumer belongs, if applicable.
For the sake of minimum statistical representativeness, ratings displayed on the Provider's website are only shown from 10 Reviews onwards, regardless of the time needed to collect them. The publication date of the first 10 Reviews is therefore the same for these, regardless of the submission date of these Reviews. In this case, some Reviews will therefore be published later than the one-month period mentioned above.
The Review publication period is on a rolling 12 or 24 months and may be extended depending on the Provider's activity. The displayed ratings are calculated on the selected period.
GetMyOpinion does not aggregate ratings (for example, for Reviews collected from several establishments of a Provider) and does not weight ratings. GetMyOpinion displays the average rating transparently for each Provider. The rating is obtained by the following calculation: Average rating = (sum of published Review ratings / total number of published Reviews).
The average rating is updated continuously as new Reviews are published.
The Consumer may request a posteriori the removal of their Review at the following address: cnil@getmyopinion.fr.
GetMyOpinion may also depublish a Review in the following cases:
• In the context of a posteriori moderation if information indicates that the Consumer and the Review content are not compliant with the GTU;
• In the event of a change of ownership or a modification of the substantial characteristics of a Product or Service, GetMyOpinion may depublish and archive Reviews prior to this change or when the Product or Service is no longer marketed;
• In case of reaching the Review expiration deadline.
GetMyOpinion retains all Reviews that have been subject to removal or depublication and all documents attached to these Reviews as well as the reason for removal for a period of 12 months.
However, it is not possible, neither for the Provider nor for the Consumer, to modify a published Review.
GetMyOpinion may display below each Review the response of the evaluated Provider.
Each Provider has the possibility to respond to Reviews submitted concerning them as long as the Review in question is online, in order to give their version of the facts, thank the Consumer for their Review, or indicate any changes introduced in the Product or Service since the Review was written.
Responses are published within 24 hours from the date of sending the response by the Provider.
The Consumer will receive an email to take note of any message addressed by the Provider.
Responses are subject to moderation under the same conditions as those provided for in Article 5 and may be subject to reporting and may be removed under the conditions of Article 9 of these GTU.
In no case does GetMyOpinion interfere in the relationship between the Provider and the Consumer, nor is it responsible for difficulties in the execution of the contract between the Consumer and the Provider. It will be up to them to manage any difficulties that arise following the purchase of the Product or Service or the submission of the Review.
GetMyOpinion allows Consumers, Providers, and internet users to report, with justification, any Review or content:
• Containing illicit or inappropriate elements;
• Clearly showing an intent to damage the reputation of the Product or Service or the Provider in order to obtain financial or other compensation;
• Contravening these GTU.
Reporting is done to the following email address: abus@getmyopinion.fr.
Reported Reviews are subject to manual moderation to verify their compliance with these GTU. During the manual moderation period following a report:
• The Review may be temporarily removed;
• A response may be sent to the person who issued the report.
If a Review has been reported or removed for the reasons stated above, GetMyOpinion undertakes to examine the Reviews previously submitted by the Consumer to determine if their removal is necessary.
The Consumer acknowledges that if one of their Reviews is reported as abusive, GetMyOpinion will be required to remove it if it is manifestly illicit and/or during the time required for verification.
The Consumer's personal data is processed in accordance with the privacy policy communicated to them.
All intellectual property rights relating to the structure and content of the Website such as images, sounds, videos, photographs, logos, trademarks, graphic, textual, visual elements, tools, software, documents, data, etc., as well as the GetMyOpinion software solution, are the exclusive property of GetMyOpinion.
The Consumer is prohibited from copying, modifying, reproducing, publishing, creating a derivative work, or using the intellectual property rights described above in any way whatsoever without the express written permission of GetMyOpinion – whether this use is for commercial purposes or not.
Non-compliant use of these rights will constitute a violation of copyright and will constitute the offense of counterfeiting. The civil and criminal liability of the Consumer may be engaged.
As indicated in Article 6, the Consumer agrees that their Review may be published on the websites of GetMyOpinion and the Provider, subject to respect for their rights concerning their personal data.
As such, if the Review is likely to be protected by intellectual property rights, the Consumer grants GetMyOpinion and the Provider the rights of representation and reproduction necessary for the publication of the Review under the conditions provided for in Article 6, for the duration planned for the publication of the Review, worldwide.
GetMyOpinion will make its best efforts to allow continuous access to its Website, diligently and in accordance with the rules of the art, except for interruptions required for maintenance, possible breakdowns, technical or legal constraints. The Consumer acknowledges and accepts that no one can guarantee the proper functioning of the internet as a whole.
The Website and services fall within a particularly complex field of computer technology and, in the current state of knowledge, they cannot materially be tested for all possible uses. In particular, the adequacy of the services to all the needs and requirements of the Consumer, which are solely their assessment, or the operation of the Website or services without errors or damage cannot be guaranteed.
GetMyOpinion assumes an obligation of means in the execution of the services. GetMyOpinion's liability can only be established in the event of foreseeable damage resulting directly from a proven breach by GetMyOpinion of its obligations in accordance with applicable provisions.
GetMyOpinion will not be liable for any damage originating from the use of the services by the Consumer that does not comply with the GTU.
GetMyOpinion cannot be held responsible for the actions or omissions of third parties to the contract, notably social networks and other websites on which Reviews are posted.
To the fullest extent possible and permitted by applicable law, the limitations and exclusions of warranty and liability provided in these GTU apply regardless of the basis of liability.
The Consumer must ensure the legality and regularity of the content they communicate when submitting Reviews, respecting the rights of third parties and current regulations.
In particular, the Consumer undertakes to indemnify GetMyOpinion against any claim resulting from the Consumer's non-compliance with their legal obligations or these GTU, including all indemnities, costs, and attorney fees that may be charged to GetMyOpinion in this regard.
Any dispute relating to the interpretation and execution of these GTU is subject to French law.
In the event of a dispute, the Consumer is informed that they can resort free of charge to a consumer mediator, after the failure of an attempt at amicable settlement directly with GetMyOpinion in accordance with the provisions of the Consumer Code.
In the absence of mediation, the jurisdictional competence is that of the French courts. The competent court will be designated according to the procedural rules in force in France.
